AGREEMENT AND RELEASE OF LIABILITY

🚙 VEHICLE REQUIREMENTS All participant vehicles must:

• Have 4-Wheel Drive (4WD) or All-Wheel Drive (AWD)

• Be equipped with off-road capable tires with tread that is in good condition.

If your tires are questionable, please email a photo of the tread to our team in advance. Vehicles with non-off-road tires ("street tires") will not be allowed. Frey’s Brewing Company LLC reserves the right to deny access if vehicle safety requirements are not met, without refund.

IMPORTANT: YOU MUST READ AND AGREE TO THIS WAIVER BEFORE PURCHASING.

By completing your ticket purchase, you (“Participant”) confirm that you understand and agree to the terms outlined below on behalf of yourself and all passengers in your vehicle.

1. ACKNOWLEDGMENT OF RISK

I understand that participating in the off-road course — even one designed for beginners — involves risks, including but not limited to:

• Driving over uneven terrain

• Loss of vehicle control

• Collisions with objects, terrain, or other vehicles

• Mechanical failure

• Weather conditions

• Injury, property damage, or death

These risks may occur on the property of Frey’s Brewing Company LLC and/or its neighboring vineyard property.

I voluntarily accept full responsibility for these risks on behalf of myself and all passengers in my vehicle.

2. WAIVER AND RELEASE OF LIABILITY

In exchange for being allowed to participate, I release and discharge Frey’s Brewing Company LLC, its owners, employees, volunteers, affiliates, and the lead vehicle driver from all liability, claims, or damages for injury, loss, or death — whether arising from negligence or otherwise.

3. FOLLOWING INSTRUCTIONS & VEHICLE OPERATION

I agree to:

• Operate my vehicle safely and responsibly

• Follow the certified lead vehicle and all event instructions

• Accept removal without refund if I or my passengers violate these conditions

I confirm:

• I am the driver of the vehicle and possess a valid driver’s license

• My vehicle is insured and roadworthy

Passengers in my vehicle do not need a driver’s license but are bound by this waiver.

4. INDEMNIFICATION

I agree to indemnify and hold harmless Frey’s Brewing Company LLC from any claim, including those brought by my passengers, that arise from my participation.

5. MEDICAL RELEASE

If necessary, I authorize Frey’s Brewing Company LLC to seek emergency medical assistance. I accept responsibility for all related costs.

6. PHOTO & VIDEO RELEASE

I grant permission for Frey’s Brewing Company LLC to photograph or film me and my passengers during the event for promotional use.

7. GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Maryland. If any part of this agreement is found unenforceable, the remainder shall still apply.

BY CLICKING “I AGREE” AND COMPLETING THIS PURCHASE, I ACKNOWLEDGE THAT I HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THIS RELEASE OF LIABILITY ON BEHALF OF MYSELF AND ALL PASSENGERS.
